Financial Planning: Exposure to Legal Liability and Claims
All businesses are exposed to potential claims and lawsuits. Rather than ignore this reality, recognize it as a cost of doing business and plan for it. The following topics are included in this discussion:
  1. The role of Errors and Omissions insurance;
  2. Identifying clients who may be litigious;
  3. identifying problems which lead to significant exposure;
  4. proactively responding to risk;
  5. how to respond to a demand or threat effectively to avoid or minimize liability;
  6. What to do when an actual claim becomes a lawsuit.

Liability Lawsuits and the Threat to Families with Emerging and Established Wealth
In these highly uncertain times, the issue of disparities in wealth, income, and taxation has become the subject of heated debate. As the controversy continues deepens and proliferates, any high net worth families are concerned this environment is heightening the risk they will be the target of a high-stakes liability lawsuit. Aside from the financial impact, high net worth individuals fear the stress of protracted legal proceedings and risk damage to their reputations and ability to earn an income.

People of means frequently fail to realize that many aspects of their lifestyle can lead to a costly lawsuit. They also tend to underestimate the potential cost of a liability lawsuit and misunderstand the affordability of effective protection. This course explores the exposures of high net worth individuals and presents a five-step plan for reducing the risk posed by liability lawsuits and the importance of building a comprehensive program for liability protection.

The major themes of the course are:
  • The growing concern among high net worth individuals that they will be targeted in aliability lawsuit.
  • The legal inequities that can directly impact high net worth individuals named inliability lawsuits.
  • The true degree of risk and the potential amount of damages that can ensue from aliability lawsuit.
  • The basics of umbrella insurance and the affordability of protection.
  • The five steps needed to build a liability protection plan.

Financial Planning: Exposure to Legal Liability and Claims, Susan Barilich, Esq.

Susan Barilich is an experienced trial attorney, who has been licensed to practice law since 1981. Ms. Barilich is the principal and founder of Susan Barilich, P.C., a law firm specializing in trial work, with an emphasis on business and commercial litigation, including simple and complex contract disputes, business torts, such as fraud and breach of fiduciary duty, and collection matters, including judgment collection, bankruptcy adversary proceedings, and fraudulent transfer cases. Ms. Barilich' cases also cover a broad range of disputes involving real estate litigation, including land use disputes, covenants and restrictions, homeowners' association issues, construction litigation and arbitration, title and boundary claims, commercial and residential real estate foreclosure disputes, commercial and residential landlord-tenant issues, and real estate contract disputes involving specific performance, breach, broker commissions, and other enforcement matters. Ms. Barilich is the author of a recently published article: "Redefining the Scope of the Fraud Exception to the Parol Evidence Rule: RiverIsland Cold Storage v. Fresno-Madera Credit Association", which appeared in the California Real Property Journal, the official publication of the Real Property Law Section of the State Bar of California.

Ms. Barilich is licensed to practice law in California and in Texas, as well as in multiple U.S. District Courts and U.S. Bankruptcy Courts sitting in both States.

Ms. Barilich is also an American Arbitration Association arbitrator.

The offices of Susan Barilich PC are located near downtown Los Angeles in Glendale, California.

Susan Barilich was born in South Bend, Indiana. She received her Bachelor of Arts degree in English from Indiana University, magna cum laude, and her law degree from the University of Houston Law School.

In her free time, she hikes, spends time at the gym, enjoys yoga, and skis, reads a lot and dabbles in politics.

Liability Lawsuits and the Threat to Families with Emerging and Established Wealth, Christopher Lopez

Christopher Lopez is a Business Development Manager for Chubb Limited. He partners with 50 independent and national insurance brokers in the Los Angeles area to provide insurance protection for financially successful individuals. Christopher believes in taking a tailored approach to insurance. When accidents or catastrophes occur, it is important that the things most important to clients: family, homes, heirlooms, assets and belongings are adequately protected.

Christopher has worked for multiple global insurance organizations in both Personal and Commercial Lines. He received his Charter Property Casualty Underwriter (CPCU) designation in 2016. He is currently working on a Certified Personal Risk Manager (CPRM) designation tailored to protecting the exposures of the financially successful, affluent and high net worth lifestyles.

Christopher holds a master's degree in Leadership and Management from the University of La Verne and a bachelor's degree in Economics from Pepperdine University.
